Facebook, FTC Reach Settlement Over Privacy Violations

On Tuesday, Facebook reached a settlement agreement with the Federal Trade Commission regarding the social network's policy on changing privacy controls and informing users of those changes.

Under the terms of the settlement Facebook must obtain approval from users before making changes to the way their personal data is shared on the network. For the next 20 years, Facebook must also submit to scheduled checkups by "independent, third-party auditors" to ensure that the company's privacy policies and practices do not violate users' rights.

"Facebook is obligated to keep the promises about privacy that it makes to its hundreds of millions of users," said FTC Chairman Jon Leibowitz, according to a release published by the agency. "Facebook's innovation does not have to come at the expense of consumer privacy. The FTC action will ensure it will not."

Facebook Co-founder and CEO Mark Zuckerberg also published a lengthy post on the Facebook Blog regarding the social network's future privacy efforts and its settlement with the FTC.

"I'm the first to admit that we've made a bunch of mistakes," Zuckerberg wrote. "In particular, I think that a small number of high profile mistakes, like Beacon four years ago and poor execution as we transitioned our privacy model two years ago, have often overshadowed much of the good work we've done."

These announcements confirm rumors earlier this month that Facebook and the FTC were reaching an agreement over the site's controversial policies regarding the protection of users' data.

(AP) ? Duke coach Mike Krzyzewski was asked about an Ohio State player and almost chuckled.

"I wasn't focused on each of their guys," he said. "I was trying not to lose by 30."

It was that kind of night for the third-ranked Blue Devils.

Jared Sullinger scored 21 points and three teammates were close behind as No. 2 Ohio State roared out to an 11-0 lead and never looked back in rolling to an 85-63 victory Tuesday night in the ACC/Big Ten Challenge.

Buckeyes fans chanted "overrated" at the Blue Devils in the final minute.

NBA star LeBron James had a front-row seat for the rout, but he was booed loudly when he walked to his courtside seat with Miami Heat teammate Dwyane Wade. That was about the only time the fans expressed any dissatisfaction with anything on the court.

"This basketball team is special," Sullinger said.

The Buckeyes (7-0) never trailed, weathering a Duke rally in the first half and then leading by 20 for most of the second half.

"Sometimes you just get your butt kicked," said Krzyzewski, who said his young team appeared tired.

Austin Rivers had 22 points and Mason Plumlee 16 for the Blue Devils (7-1), coming off wins over ranked opponents Michigan and Kansas in their previous two games.

William Buford scored 20, Deshaun Thomas 18 and Aaron Craft 17 for the Buckeyes, who gave the Big Ten a 4-2 edge in the conference matchups. Craft also had eight assists and five rebounds and was a terror on defense.

Few would have expected such a lopsided result. Duke came in with a record of 11-1 in ACC/Big Ten games and had beaten its last five Big Ten opponents ? including conference bullies Michigan State and Michigan already this season.

The Blue Devils had also won their last four games in which both teams were ranked in the top five.

The Buckeyes led by 24 with 15 minutes left after Craft banked in a 3 ? he laughed after it clanked in. The Blue Devils responded with a 7-0 run to get as close as 58-41 but Ohio State continued to control the paint. Sullinger was fouled and hit two foul shots, then powered up a shot off the backboard for a 66-43 lead shortly before clock trouble allowed both teams to take a breather with 8:42 remaining.

On consecutive possessions, Ohio State got a dunk by Sullinger and a 3 by Craft thanks to around-the-horn passing that found an open player.

"We were taking great shots," Craft said of the Buckeyes, who shot 59 percent from the field and made 8 of 14 3-pointers. "It all started with Jared inside. That just opens everything else up."

It was a festive, rock-concert sort of a capacity crowd of 18,809 at Value City Arena for the game, which was billed as the biggest nonconference home game ever for Ohio State.

One female student held up a sign meant for Sullinger that said, "Jared, will you marry me?" When Rivers ? the son of Boston Celtics coach Doc Rivers ? had a turnover, the Ohio State student section chanted, "Daddy's boy! Daddy's boy!"

The first half was a shocker, with Ohio State setting the pace early, shrugging aside a Duke comeback and then pulling away for a gaping 47-28 lead at the break as Buford and Thomas each had 13 points.

"I was sort of the X factor," Thomas said with a grin.

The Buckeyes ran off the first 11 points ? five by Craft and four by Buford ? while Duke's younger players appeared nervous and tentative.

"They just jumped on us from the beginning," Plumlee said. "We weren't ready to play."

After Plumlee ended the cold start with a shot over Sullinger 4 minutes in, the Blue Devils regained their balance as Rivers and Seth Curry took turns beating the Buckeyes off the dribble for layups.

Plumlee's reverse dunk ? the crowd howled that he traveled ? cut Ohio State's lead to 18-17 at the 9:50 mark.

But just that quickly, the Buckeyes ? who won their 29th in a row at home ? streaked away again.

After Buford made two foul shots, Sullinger hit a leaner off glass and Plumlee protested his second foul, with the Buckeyes sophomore completing the three-point play. Substitute guard Jordan Sibert went high over the rim to tip in a miss before Buford scored in transition. Thomas then tossed in a half-hook from the left baseline to cap a 10-0 run that made it 28-17.

During that spell and beyond, the Buckeyes scored on eight consecutive possessions. When Craft hit a 14-foot jumper off a kickback pass from Sullinger at the 5:38 mark, it was 34-21. The lead never dropped below double digits again.

The Buckeyes, typically a mild-mannered team on the boards, won the rebound battle (33-27) and outscored the Blue Devils 15-0 at one point on second-chance points.

It was Duke's second game in Columbus. In the only other meeting in Ohio's capital city, the Blue Devils won 94-89 in double overtime on Dec. 30, 1964, at old St. John Arena.

The Blue Devils had won their last 35 games in November, dating to a 73-62 loss to Marquette in 2006.

But not tonight.

"I've had my butt kicked before," Krzyzewski said. "We've kicked some butt. Tonight my butt's sore."

Relativity in $200 million loan from Ron Burkle (Reuters)

LOS ANGELES (TheWrap.com) ? Just weeks before the release of his first big-budget epic, "Immortals," Relativity Media CEO Ryan Kavanaugh took a $200 million loan from billionaire Ron Burkle, TheWrap has learned.

The loan was obtained from Colbeck Capital Management, a fund in which Burkle has invested. The money was needed to help Relativity cover "Immortals'" multi-million marketing costs and also so that Relativity could continue to make movies, according to several individuals with knowledge of the loan.

The loan terms included giving Colbeck close to 5 percent of the gross box office receipts from "Immortals" and from Relativity's upcoming Snow White epic, "Mirror, Mirror."

Individuals close to the deal differed over how onerous the terms of the loan were. One person involved said the loan was obtained at an 8.5 percent interest rate, and defined the gross figure as coming only after advertising and production costs have been recouped.

But another person with knowledge of the deal said that the interest was at 15 percent, and that Colbeck would receive "first dollar gross," meaning cash direct from box office receipts.

A spokesman for Relativity had no comment.

Colbeck Capital declined to comment.

At a cost of around $85 million, "Immortals" has so far taken in $69 million domestically since its November 11 release, and is on track to be a modest moneymaker for the studio.

But with prints and advertising costs running into the tens of millions of dollars, the studio needed cash ahead of release, and had secured it from another fund before striking the deal with Colbeck.

The involvement of Burkle, a Los Angeles billionaire with ongoing interest in the movie business, is a new wrinkle in the story of Relativity and its swashbuckling chief, Kavanaugh.

Burkle came close to buying Miramax with Harvey Weinstein two years ago, and currently co-finances movies with The Weinstein Company.

One individual close to the parties involved said that Burkle is circling a JP Morgan deal to buy out Elliott Management's minority interest in Relativity. The investment bank has been quietly negotiating with Relativity for months to lead a $700 million investment in the company, a story that TheWrap broke in May. That deal has not yet closed.

If Burkle were to buy an equity stake as part of the JP Morgan deal, then presumably the loan would be renegotiated at more favorable terms.

Colbeck Capital Management is led by two former investment bankers, Jason Colodne and his partner Jason Beckman, who previously worked together sourcing and investing in distressed credit at Goldman Sachs.

Relativity has in the past year expanded to become a full-fledged independent studio, complete with a distribution system. The studio aims to produce 10 movies next year, including "Mirror, Mirror" in March, starring Julia Roberts in an stylized remake of the Snow White story.

Many in Hollywood have been skeptical of Kavanaugh's ability to continue financing his ambitions for his studio, but the young mogul always seems to succeed in proving his naysayers wrong and find a new financial backer.

In May, Kavanaugh sought out JP Morgan senior banker Ryan O'Hara to buy out Elliott's stake under a clause that gave him the option to do so at a certain price.

The move followed months of reports of tension between the independent studio and the hedge fund. Elliott, which manages some $15 billion in capital for institutional and private investors, has been Relativity's primary financial backer as the company has grown from a production house to an independent movie distributor.

The hedge fund has been tightening the cash spigot on Relativity in recent months, making it hard for the studio to finance its slate, and to find the necessary cash to release its completed films.

Yuvraj, 29, who was declared the man of the tournament after the World Cup win in April, had opted out of the forthcoming one-day series against the West Indies for health reasons.

Ashwin lifts India after Tendulkar agony (Reuters)

MUMBAI (Reuters) ? Sachin Tendulkar fell agonisingly short of his 100th international century once again before off-spinner Ravichandran Ashwin lifted India's spirits with his maiden test ton on the fourth day of the third test against West Indies on Friday.

India finally reached 482 all out in reply to West Indies' 590 and left-arm spinner Pragyan Ojha sent back Adrian Barath (3) and Kirk Edwards (17) early to raise India's hopes of an unlikely victory,

However, Kraigg Brathwaite (34 not out) and Darren Bravo (27 not out) then thwarted the visitors to take West Indies to 81 for two at the close.

Ashwin, who took five wickets in the West Indies' innings, scored 103 to bring the smiles back to the faces of the Mumbai crowd after the disappointment of Tendulkar's latest near miss.

Ashwin hit 15 boundaries and two sixes in his 118-ball knock and steered paceman Ravi Rampaul to the third man boundary to bring up his century. He departed to the next ball, miscuing a pull shot to leave India trailing by 108 runs.

Tendulkar, unbeaten on 67 overnight, hit three boundaries and a six in the first session and looked set to secure the century that has eluded him since he last reached triple figures against South Africa during the World Cup in March.

With the whole of India celebrating every run as he closed on the landmark, Tendulkar's innings came to an abrupt end on 94 when he edged Rampaul to West Indies captain Darren Sammy at second slip.

Virat Kohli (52) brought up his maiden half-century in tests, and with Ashwin took India past the follow-on mark.

Kohli and Ashwin stood firm and added 97 runs for the seventh wicket after India were reduced to 331-6 and needed a solid partnership in the wake of Tendulkar's shock departure.

The tail hung in with Ashwin to help him complete his 100 after Kohli hit leg-spinner Devendra Bishoo straight to Fidel Edwards at mid-on.

India had resumed on 281-3 and Sammy was rewarded for taking the second new ball immediately when Vangipurappu Laxman (32) fell to the first ball of the day's second over.

Laxman was dismissed when he drove the first ball he had faced, bowled by paceman Fidel Edwards, straight to Marlon Samuels at gully after he and Tendulkar had added 63 runs for the fourth wicket.

India captain Mahendra Singh Dhoni did not last long either, clean bowled by Sammy for eight to expose the home team's tail.
